Data controller. The operator of the PicksDb service and the primary controller of personal data described in this Policy is PicksDb LLC, a United States limited liability company. For privacy requests: support@picksdb.com. Where we use processors (e.g., payment partners, app stores, hosting providers), they process data under their own notices as explained below.

Introduction

Your privacy matters. This policy explains what we collect, why, and your choices. PicksDb is an all-sport social and creator platform—users discuss NFL, MLB, NBA, NHL, NCAA, MLS, UFC/MMA, boxing, and more. We are not affiliated with any league or team and do not claim ownership of league trademarks.

This Policy is not legal advice. It does not list every law that may apply to you. For regulated or high-risk processing, consult qualified counsel.

1. Quick Summary

High-level overview of our privacy practices:

  • We collect account, activity, and limited device data to operate PicksDb.
  • We use service providers (authentication, cloud hosting, analytics, payments) under contracts with data protection safeguards.
  • Public content you post (e.g., posts, comments) is visible by design.
  • We do NOT sell your personal data to third parties.
  • You can manage settings, request data export or deletion, and contact us with privacy requests at support@picksdb.com.
  • If you enable creator payouts, onboarding and banking happen via a payment partner; we do not store your full bank details.
  • In-app purchases may be processed by Apple or Google; payment data, refunds, and purchase history for those flows are handled under Apple’s or Google’s policies (see Apple Media Services Terms / Google Play terms for your region).
  • For card or web checkout payments, disputes and chargebacks may be handled through your bank and our payment partner; we may share transaction metadata to respond to claims.
  • Optional in-app virtual currency PicksDb Coins™ (“coins” in-product) has no real-world cash value and is used only inside the Service as described in our Terms of Service.
  • Creator Shop: if you buy from a creator’s shop or operate a shop, we process order, listing, payment metadata, shipping, affiliate click events, and fraud-prevention data as described in Section 5a below.
  • Leaderboard and ranking features (PicksDb Leaderboard™) may process activity and engagement data to display rankings as described in the app.
  • Sports data comes from public sources; we do not sell your data to the NFL, MLB, NBA, NHL, UFC, or other leagues or sportsbooks.

1b. Public (Global) Live Chats, Threads & the Picks Marketplace

Public rooms are public. When you create or post in a public (global) live chat, a public thread, or a public post, the content is visible to every PicksDb user, may be surfaced on Browse → Chat, and may be shown on the host's profile (including as archived "past" rooms once ended). Anyone in the community can view, screenshot, quote, or report public content. Use a private DM or invite-only / subscriber-only room if you need a smaller audience.

Picks Marketplace. When you subscribe to a creator on the Picks Marketplace we process limited transaction metadata (tier, creator, price, billing period, payment reference identifiers, status) so we can grant you access and manage billing. Payment credentials are handled by our payment partners, and (for in-app purchases on mobile) by Apple or Google under their respective privacy notices. PicksDb does not store full card numbers, CVVs, or bank account numbers. Subscriptions buy access to creator content and opinions only — not bets, prizes, or guaranteed returns.

1a. Major Leagues & Third-Party Data (NFL, MLB, NBA, NHL, MMA, and More)

PicksDb processes account and content data when you post or chat about any sport, including professional and college football (NFL, NCAA), baseball (MLB), basketball (NBA, WNBA, NCAA), hockey (NHL), soccer (MLS, international), combat sports (UFC/MMA, boxing), and other categories.

No league affiliation or ownership. PicksDb LLC is not affiliated with the NFL, NFL Properties LLC, MLB, the NBA, NHL, NCAA, FIFA, MLS, UFC, Zuffa/TKO, or any team or promotion. We do not own NFL®, MLB®, NBA®, NHL®, UFC®, or other league marks. Schedules, stats, and names may be shown from public information for community discussion only.

2. What We Collect

Complete list of data we process:

  • Account Data: name, username, email address, profile photo, bio, and profile details you provide.
  • Activity Data: posts, comments, likes, follows, shares, predictions, picks, and basic app usage analytics (features used, time spent).
  • Communication Data: chat messages, direct messages, live chat streams, thread posts, room messages, message timestamps, recipients, chat room IDs, message reactions, and all content you send through communication features.
  • Prediction Data: predictions you make, odds information you view, hypothetical tracking data (units, hypothetical winnings calculations) - all for entertainment purposes only.
  • Social Data: users you follow, users who follow you, profile views, social interactions, and social feed activity.
  • Device/Technical Data: device identifiers, IP address, app version, operating system, diagnostic logs (for security and reliability), crash reports.
  • Location Data: approximate location (region/country) for compliance purposes.
  • Preferences: notification settings, sports and topics you follow, tags, and app preferences.
  • Moderation Data: reports you file, content moderation actions, policy violation records, communications flagged for review.
  • Creators (if applicable): payout and tax information collected by our third-party payment partner (we do not store full bank details or government ID numbers).
  • Creator Shop (if applicable): product images, listing metadata (titles, prices, badges, Amazon URLs, ASINs), Amazon affiliate tags, outbound click events, checkout funnel events, in-app order and payout records, shipping addresses, payment method metadata (not full card numbers), fraud signals, and policy acceptance timestamps.

3. How We Use Data

Why we collect and process your data:

  • Service Delivery: create and secure your account; render feeds, profiles, predictions, odds displays, chat rooms, direct messages, live chat streams, and app features.
  • Communication Features: deliver your messages to recipients, display chat rooms and threads, enable live chat streams, facilitate user-to-user communications.
  • Entertainment Features: display odds information (for informational purposes only), calculate hypothetical tracking data (units, hypothetical winnings) for entertainment purposes only.
  • Personalization: tailor content recommendations and app experience based on your activity and preferences.
  • Safety & Moderation: detect, investigate, and help prevent abuse, spam, fraud, policy violations, and illegal activity; monitor communications for safety; enforce Terms of Service; review reported content and messages.
  • Analytics & Improvements: understand app usage patterns to improve features and fix bugs (aggregated, anonymized data).
  • Legal compliance & safety: comply with applicable laws; respond to lawful requests; enforce our Terms of Service; protect rights and safety; and disclose information to law enforcement or regulatory authorities when we reasonably believe it is necessary to address crime or serious harm, or when required by law or compulsory process (see also our Terms regarding illegal conduct).
  • Communication: send you service notifications, updates, and responses to your requests.

4. Sharing

We do NOT sell your personal data to third parties.

We may share limited data with:

  • Service Providers (authentication providers, cloud hosting, analytics partners, payment processors, communication infrastructure providers) under strict contracts with data protection safeguards and purpose limitations.
  • Law Enforcement when required by law, court order, or to protect safety (including communications data and message content).
  • Business Transfers in connection with a merger, acquisition, or sale of assets (with user notification).
  • Public Content you post is visible by design to other users on the platform.
  • Communications you send are delivered to intended recipients (chat messages, direct messages, live chat streams).
  • Other users in chat rooms, threads, and public communications can see your messages and profile information.

We never share your personal data for marketing purposes without your consent.

Important Note: Communications sent through our platform are NOT private or encrypted. We may access, monitor, and store all communications for safety, moderation, and legal compliance.

5. Payments, disputes & store purchases

How payments are processed securely:

Many card checkouts and creator payouts flow through licensed payment partners. We do not store full payment card numbers or full bank account numbers on our servers. Partners process personal data under their own agreements. We receive limited information (e.g., reference identifiers, payment status, dispute status) to operate the Service.

Disputes and chargebacks. If you or your bank opens a dispute or chargeback related to a payment, the payment partner and/or card network may share claim details with us. We use that information to investigate and respond where permitted. Outcomes are governed by partner and network rules, as described in our Terms of Service.

Some purchases are billed through the Apple App Store or Google Play. Those platforms process payment data and handle refund requests under their own terms (e.g., Apple Media Services Terms; Google Play terms for your region). PicksDb LLC does not receive your full card number from Apple or Google for those purchases.

5a. Creator Shop — listings, orders & affiliate data

When you operate or purchase from a Creator Shop on PicksDb, we process additional data to operate checkout, enforce shop policies, and protect buyers.

Creators (sellers)

  • Listings: product images, titles, prices, badges, descriptions, Amazon URLs, ASINs, and affiliate tags you provide.
  • Policy acceptance: when you accept seller integrity and Amazon affiliate disclosures in Shop settings, we record that acceptance to enforce publishing rules.
  • Amazon affiliate analytics: we log outbound click events (creator, product, timestamp) shown in your shop dashboard. We do not receive Amazon commission reports, sales totals, or payment data from Amazon on your behalf. You are responsible for your Amazon Associates account privacy and compliance.
  • Orders & payouts (in-app): order line items, paid-at timestamps, Stripe payment intent and charge identifiers, shipping addresses, product snapshots at purchase time, discount/deal snapshots, and whether payment was recorded via app confirmation or payment-partner webhook. Retained for buyer history, fulfillment, chargeback response, and compliance (typically up to 7 years for transaction records).
  • Fraud & enforcement: we may review uploaded product photos and listing details to detect misrepresentation or counterfeit goods. If we identify suspected fraud, we may retain related records longer, share limited data with payment partners (Stripe, Apple) for chargeback and fraud investigation, and disclose information to law enforcement or regulators when required by law.

Buyers (fans)

  • In-app checkout: account identifier, shipping address, order details, payment method type metadata (e.g. Apple Pay, card brand/last four — not full card numbers), transaction timestamps, and product snapshots.
  • Checkout recovery: if payment succeeded but order confirmation was interrupted, limited recovery data may be stored temporarily on your device.
  • Customer claims: reason, description, order ID, claim status, and admin responses when you submit a shop or billing claim for support review.
  • Amazon links: when you tap an Amazon link, you leave PicksDb. Amazon’s privacy policy governs data collected on Amazon’s site. We log the outbound click event for creator analytics only.

We do not sell shop purchase data to third parties. We share limited transaction metadata with payment partners to process payments and resolve disputes. Creators who misrepresent products or violate affiliate rules may be permanently banned and reported as described in our Terms of Service — Creator Shop sections.

FTC & fan-facing disclosures

Creators must provide clear disclosures to fans when content includes affiliate links (#ad, paid link, commission earned) as required by FTC guidelines and applicable law. PicksDb may display platform-level notices that Amazon purchases happen on Amazon and that creators may earn commission from Amazon — not from PicksDb. PicksDb is not your employer or Amazon Associates agent; your relationship with Amazon is solely between you and Amazon.

6. Community Safety & Moderation

How we process data to keep PicksDb safe:

To enforce policies and keep the platform safe, we collect and process:

  • Content you post (posts, comments, messages, group chat messages, direct messages, live chat streams, threads) for moderation purposes.
  • Group and room data: group/live/thread IDs, membership, invites, host settings, and access rules (PicksDb LLC operates these features; hosts do not own the platform).
  • Reports you file about other users or content, including reason codes and context you provide.
  • Block and mute lists.
  • Moderation actions taken (warnings, restrictions, room closures, bans).
  • Metadata associated with content (timestamps, device info, IP addresses, chat room IDs, message recipients).
  • Automated detection signals (keyword filtering, spam detection, policy violation patterns).

We aim to review user reports and take action on violating content within 24 hours where practicable. Human moderators may review automated flags. We may monitor, review, and store communications for safety, moderation, legal compliance, and abuse prevention. We may share data with law enforcement when we believe it is necessary to address credible threats, illegal activity, or as required by law. We retain moderation data as long as necessary for safety, typically up to 12 months after account closure.

6a. Crisis support, mental health & threatening behavior

PicksDb is not a mental health provider or crisis service. Chats and posts are for entertainment and community only. If you are in crisis or may harm yourself or others, contact emergency or crisis services immediately—do not rely on PicksDb for help.

How PicksDb handles concerning content. If we become aware of content suggesting self-harm, suicide, threats of violence, severe harassment, or exploitation—through user reports, automated signals, or other means—we may remove content, restrict accounts, preserve records, and contact or cooperate with law enforcement or crisis responders where permitted by law and where we believe it is necessary to protect safety. We do not guarantee that we will identify every harmful message or respond in real time.

Reporting in the app. Use in-app Report and Block on posts, comments, messages, and profiles. For urgent safety issues you may also email support@picksdb.com with “Urgent safety” in the subject line. We are not a substitute for 911 or 988.

Depression, anxiety, and emotional distress. Peer chat on PicksDb is not therapy. If you are struggling with mental health, please reach out to a qualified professional or one of the crisis resources above. We may remove content that promotes self-harm or encourages others to harm themselves.

7. Data We Do Not Collect

What we avoid storing:

We do not store full payment card numbers, full bank account details, government ID numbers (except as necessary for creator onboarding via payment partners), biometric data, or data from proprietary league or promotion databases without authorization. If future features require sensitive data, we will provide clear notice and obtain appropriate consent.

7a. Third-Party Rights & Your Content

You may discuss teams, athletes, and leagues on PicksDb, but you must not use the platform to infringe third-party intellectual property or publicity rights. If you post league logos, clips, or claims of official status without authorization, you—not PicksDb LLC—are responsible for that use. We may remove content in response to valid rights-holder complaints. Contact: support@picksdb.com.

8. Age, Location & Compliance

Protecting minors and honoring local laws:

PicksDb is NOT directed to children under 18. We do NOT knowingly collect personal information from users under 18. We require users to be 18+ to create accounts. If we discover that we have collected data from a minor, we will delete it immediately and terminate the account.

We apply age restrictions (18+) and may use coarse location (e.g., region/country) to comply with applicable laws and to disable features that could be construed as wagering. We do not provide a sportsbook or prize contests. We may adjust features by jurisdiction where required.

9. Legal Bases (EEA/UK)

Contract, legitimate interests, legal obligations, consent:

  • Contract: to provide PicksDb and requested features.
  • Legitimate interests: to keep PicksDb secure and improve features, balanced against your rights.
  • Legal obligation: to comply with applicable laws.
  • Consent: where required (e.g., certain notifications or analytics). You may withdraw consent at any time.

10. International Transfers

Cross‑border processing and safeguards:

Your information may be processed in countries other than your own. Where applicable, we rely on appropriate safeguards (such as contractual clauses) for cross‑border transfers.

11. Creators & Payments

Third‑party onboarding, payouts, and tax information:

If you enable creator features and payouts, payment onboarding (including bank account and identity verification) is handled by our third‑party payment partner. PicksDb does not store your full bank details. The payment partner processes payout and tax information subject to its own terms and privacy policy. We may receive limited status information to operate creator features.

12. Your Controls & Rights

Manage account data and exercise privacy rights:

You can:

  • Update or delete profile information in Settings
  • Control notification preferences
  • Request a copy of your data (data export)
  • Request account deletion
  • Request correction of inaccurate data

California residents (CCPA): You have the right to know what personal information we collect, delete your personal information, opt-out of sale (we do not sell data), and non-discrimination.

EU/UK residents (GDPR): You have rights to access, rectification, erasure, portability, restriction, and objection.

To exercise any rights, contact support@picksdb.com. We will respond within 30 days.

13. Security

Safeguards we apply and your role in security:

We apply reasonable technical and organizational safeguards: encryption in transit (TLS) and at rest where supported; access controls and authentication; monitoring for unauthorized access; regular security assessments.

No method of transmission or storage is 100% secure. You are responsible for: using a strong password; keeping your login credentials confidential; reviewing your connected devices; reporting suspicious activity.

14. Data Retention

How long we keep data and why:

We retain personal data as long as necessary for: Service provision (while your account is active); Legitimate business needs (security, fraud prevention); Legal compliance (tax records, legal holds, dispute resolution).

Retention periods:

  • Account data: until account deletion request
  • Content you post: until deletion or account closure
  • Moderation data: up to 12 months after account closure
  • Analytics data: 24 months maximum, then anonymized
  • Legal/transaction records: 7 years for tax and legal compliance

Deleted accounts are permanently removed within 90 days. When data is no longer needed, we securely delete or de-identify it.

15. Children

Age limitations and children’s data:

PicksDb is NOT directed to children under 18. We do NOT knowingly collect personal data from users under 18. We require users to be 18+ to create accounts. If we discover that we have collected data from a minor, we will delete it immediately and terminate the account.

If you are a parent or guardian and believe your child under 18 has provided us with personal information, contact support@picksdb.com immediately and we will delete the information.
